What is the Difference Between Mediation, Arbitration, and Litigation? 

Mediation

     Mediation is a process where disputing parties resolve disputes outside of the courtroom with the help of a neutral third party, the mediator. The mediator guides the parties through a structured, confidential settlement discussion and assists the parties in developing options for an amicable resolution. The parties are in control of the terms agreed upon, which are manifested in a legally binding contract (written by the mediator). The mediator does not represent the parties and shows no bias towards one or the other.  Each client may bring an attorney to mediation, but attorneys are not required to be involved. Mediation offers an effective, confidential alternative or supplement to litigation that is both time and cost efficient. 

Arbitration

Arbitration is another process for resolving disputes outside of court. A neutral third party, called the arbitrator, listens to both sides of the dispute and makes a decision that is binding on both parties. Arbitration can be a faster and less expensive alternative to going court, and it can used to resolve a wide range of disputes, including those related to business, a breach of contract, personal injury and consumer issues. The arbitrator does not represent the parties.  Each client may bring an attorney to arbitration, but attorneys are not required to be involved.

 *Our hourly rate is $150. We require an up-front deposit for the first six hours ($900).
